You do realize that federal law supersedes state law, right? The federal law is used to convict the accused. State law dictates the manner in which the sentence is to be carried out (ie: lethal injection, electric chair etc). If the state in which the perpetrator is being held does not uphold the death penalty, the federal court will attempt to remand the perpetrator to a state that adheres to the death penalty. Yes, the current state “can” try to block such attempts, but is rarely successful.

Sum….. the other poster is “party” correct. Constitutionally, we are not to have a “standing army” (this includes all other branches except the department of the Navy). However, the constitution permits a “temporary” funded army. Hence the reason congress must reappropriate military funding every couple years.

You didn't ask about abortion, you asked about why contraception is a Constitutional right, which was ruled 7-2 in Griswold vs CT. I cited that case plus the opinions of the Justices on why contraception is a right protected by the Constitution. So I directly gave you the answer to your question, and you... have pretty much nothing to say back. At least I'd like to hear your arguments as to why those 7 Justices were wrong.
If you believe that only enumerated rights are constitutionally protected, then the US cannot have an Air Force since the Constitution says that the US can set up the Army and Navy... no mention of an Air Force.
Also, your argument that only enumerated rights are protected is pretty retarded, since in the 10 amendments which make up the original Bill of Rights, Amedment 9 is this:
Amendment IX:
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
I guess you never got your GED, but if you just do a little bit of research, you'll find why this Amendment was added:
"The Ninth Amendment was James Madison’s attempt to ensure that the Bill of Rights was not seen as granting to the people of the United States only the specific rights it addressed. "

Wow , I just listened to Jesse Watters and he had the Indiana AG on and he knew nothing about it . Columbus Dispatch is reporting it but they are also saying OHIO has a law that an underage rape Victim can get an abortion in the state of Ohio . I wonder why IF true they are politicizing this . IF true she could have got the abortion performed no questions asked . This doctor in Indiana has some questions to answer.

Now the hospital is investigating the doctor and she could lose her license . She is on record performing operations on child abuse cases and not reporting …..OH yea the AG said this is against HIPPA. And she could lose her license . But they are investigating , using a tragedy if true for political gain.
