As stated by me before, “There is nothing in sec B that says WHY a pregnant woman cannot be executed. It simply states that they will not be executed.”

Is there anything in sec b that states the reason? Yes or No? Am I missing something? I am big enough of a man to admit if I have missed something.

No, I’m agreeing with the courts and treating a fetus as what it really is….an unborn person. And all persons deserve to be protected. That is why we put into law that we will not put to death a pregnant woman. It is also why we prosecute murders for two murders when they kill a pregnant woman. Just who do you think the second count of murder is for? It is for the unborn child. Look up the legal definition of murder……”Murder is the unlawful killing of a human being with malice aforethought. ” It can only be “murder” if the action was against a “human”. Ergo, the fetus is being treated (legally) as any other human and thus must also receive the same rights as any other human.

I think people are getting confused with the state/federal distinction.

If you are convicted of murder under state law, the authorities can not move you to a state with a death penalty and murder you.

If you are convicted of murder under federal law, they can.

Under the Constitution, the state legislatures retain much of their sovereignty to pass laws as they see fit, but the federal government also has the power to intervene when it suits the national interest. And under the “supremacy clause” found in Article VI, federal laws and statutes supersede state law.

Wow, talk about little or no understanding about our judicial system. I’ll make it easier for you to understand. There are many states in the 9 circuit. Let’s say you were convicted in one state that does not permit capital punishment (like California), yet the federal law that governs the 9th circuit does. You are sentenced to death (in federal court) but reside in a federal prison that is in a state who’s laws do not allow capital punishment. You would be moved to a different federal prison, in the same circuit (ie: Arizona), who does allow capital punishment. Then the sentence can be legally carried out (after you have exhausted all appeals).

So the example of the 9th circuit contains California (no death penalty state) and also Arizona (a death penalty state). In all honesty, I thought the very same thing as you….. Until this very example was brought up by a fellow, savvy, student.

In California, with a 151 you have about a 60% chance of passing the bar on your first attempt.

With a 172, that chance increases to virtually certain.

But law school is a long haul.
