No, I do not think it will be fraud. I think there will be legislation not allowing him to do what he has done. Contractually, there is probably already provisions for people to get their money back. But if he is publically stating that the vehicles will be out in X time and conistently misses it, that is what I think they will fix. The government could do things such as force the funds into an escrow account that is controlled by a third party. Tesla could not touch the cash, the buyer could pull the cash if the delivery time is not met and the escrow is covered in BK.

I agree that most people are not going to pay for twitter. FB and Google has shown that people are ok getting services for free as long as they are the customer :) I remember when FB went public. They had to announce the valuation of a user. It was under $5 per user per year. Today, last I checked it is over $100.

I am not sure about the wealth issue. I have argued that Tesla has a huge market advantage that other car makers do not. One is the apple cult like following. But the major one is the supercharger network. Imagine selling the car and the gas! That is what Tesla has done. If I were GM, I'd invest like a MoFo in the GM charger network. Now, fortunately, TSLA got the market to pay for that and the PE ratio shows that. GM would have a tougher time, but it is sellable to the market. TSLA is slightly ahead of the other car makers in automation. What TSLA is not good at is volume sales. They started in the high end price point and are really staying there. The other car makers can hit all the price points.

First thing..... could be accused of and/or charged with fraud for not delivering the cars as promised.

Then, pay back CASH to the people and corps that paid deposits.

Then look at all of the advertisers that have bailed or threatening to bail. Any auto maker gonna advertise on a platform owned by an auto maker????

Even the average Joe Twitter acct holder would scoff at paying 2-10 bucks per month for unverified accounts without the blue checkmark.

And..... since he wants to make Twitter lean politically to the Right, the people and corps on the Left are gonna bail.

I can't see this dude being the major holder of Twitter 3 yrs from now. He's gonna sell stocks left and right.

He'll still be rich, but won't be able to claim the Top 5 in the World in about 2-3 yrs from now.

  1. If you were a shareholder of Tesla it would matter what Musk's actions are. Rember the whole concept of fiduciary responsibility. The board has a responsibility as well.

Consumers are finicky. It takes a long time to build up trust, it takes a minute to destroy it. Musk has a lot of walls closing in on him regarding Tesla. The state of CA is going after Tesla for claims regarding FSD. I think the states/feds are looking into the practice of taking deposits and not delivering within a period of time. Tell me about those Tesla Semis, Cybertrucks, Roadsters that they took cash for and have not delivered :) I guess Tesla is the ultimate IndieGoGo participant.

I am not going to judge how Musk does with Twitter for a little bit. I think he is going to be driven to get his cash back. He has mentioned that they are looking at charging $20 a month for 'authenticated' accounts and that there are 400k of those. Assuming that he gets 100% that is a whopping ~$100mm a year (rofl) He is sucking up to advertisers which is interesting because as the CEO of Tesla he has made comments against advertisers. He has made comments about PR firms and ad agencies and bad they are. Now he needs them.

I think he is looking at a 3 year window before he pushes Twitter back into the public arena. That gives him 12 quarters to turn the shit around and for the market to be OK with it. Will he have pulled enough cash and gotten enough on the IPO to get his cash back? That is the $44 bn question.

And for sure there are trips to Delaware for him now which is only a good thing. The fact that this administration doesn't talk to him is insane. Especially when it comes to EV's

Musk has lost a lot of his paper wealth, but is still incredibly wealthy. I still think he will see the ramifications of his Twitter decisions with Tesla.

Piss off China? Fine, the government will kick Tesla out and help push BYD more.

Piss off India? Fine, the government will kick Tesla out help Tata more.

Piss off Germany? Fine, the government will just make Tesla's life hard and support VW and Mercedes more.

This is why the shareholders of Tesla are pissed and nervous.

TSLA shares are nearly 50% of the 52-week high.

TSLA did an interesting pseudo-dividend a little bit ago. To me, this was an interesting way to pay a huge dividend to Musk!

Tesla did a 3:1 split on price, but gave 5:1 on shares. That was a dividend play basically. The shares were at $900 when the split hit, so people would effectively be in at $180. The stock is at $220 right now. Guess who owns the most shares of TSLA? Musk. Guess how he helped fund his Twitter purchase? TSLA.

Something tells me that Musk will be spending more time in Delaware in the next year.

Interesting how Musk fired a few key people within hours of meeting them, claiming 'cause' so he would not have to pay for their golden parachutes. I guess he really likes litigation.

Musk is demanding from managers a list of people to fire before Nov 1 to ensure their bonuses do not vest on Nov 1.

I think Musk is going to keep quite a few employment lawyers busy.
