From a friend, US Senator Marco Rubio has introduced a constitutional amendment to keep SCOTUS at 9 members. I don't know status (in committee?, on agenda?) Until I get back to work on Tuesday. What are THE SNIFFER AND THE COMMANDO HO going to say now? They have been upstaged by Senator Rubio. Now the issues is a Republican election issue more important than Covian-19. SNIFFER and HO have to pick a side in a loosing battle.

The number of SCOTUS justices is not in the Constitution.

The number of justices had been as low as 5 and as high as 10.

But Biden couldn't do it anyway. Congress sets the number, which has been 9 since 1869.

Technically true, but the rest of your rant is not.

There is NOTHING in the constitution about the size of the Supreme Court. It has been expanded before. There is nothing in the constitution that it is a lifetime appointment either.

Technically, Trump or Biden could pressure the House to work on getting a bill that would expand the court. They could even put in term limits. Then it would get voted on, sent to the senate if it passes, and then if the Speaker wants it voted on, then the senate would vote on it, then it would go to the Presidents desk and he/she could sign or veto it.

There is NO amendment needed.

As far as the constitution states regarding lifetime appointments, this is where the originalist ABC would have a field day. The constitution mentions removals, it does not mention time of service. And then, it can be argued wtf is good behavior.

This is from the constitution:

"The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office."

Notice how it says that Congress may from time to time ordain and establish. That gives congress control over the court.
